You see, if you’ve been injured in a truck accident, you need to hire truck accident injury lawyers who specialize in your specific personal injury case.

Unlike vehicle accidents, the laws for truck accidents are different and you need to contact truck accident injury lawyers as fast you possibly can. Also, if you expect to receive compensation for your injuries, you need to know who’s responsible for that. The article below by Joseph Devine sheds some light on exactly who’s liable for paying your insurance claim. Hopefully, you find the information helpful.

Who Is Liable for Truck Accident Injuries?

By Joseph Devine

Truck accidents, when they occur, leave a trail of destruction behind them. This is because these multi-ton machines, moving at speeds of up to 80 miles per hour, create a force that is unmatched by any other vehicle that is on our roads. 18-wheeler accidents are becoming more common every day. This is due to the increased need for goods to be delivered every day. On top of which, the trucks are moving at a faster pace than ever before. These two items combined are pushing the trucking industry to its limits. The main question that occurs following an injury accident that involves an 18-wheeler is “Who is liable?” In many cases, there are a number of people that can be liable for the injury.

The Driver

The most common individual to be liable for an injury is the driver of the 18-wheeler. In most cases, the individual driver will, as a minimum, be named in the lawsuit. This is because the driver is the one to have supposedly caused the injuries that were the result of the accident.

The important pieces of information in your case regarding the liability of the driver are if the driver was an employee of a major trucking company, if the driver was driving his or her private truck on their own, or if the driver was driving for a major hauling company but as an independent contractor. Each of these situations could make a difference as to who will be liable ultimately for your injuries.

The Trucking Company

The other key person that could be liable is the company for whom the truck driver is working. This is only applicable if the driver is working as an employee of that company. It is important to note that working for a major company may not be enough to bring the trucking company into the case. The truck driver, in many cases, needs to have been driving their truck when it hits an individual’s car in a way that is directly related to a job. Specifically, the truck driver in many cases cannot have been driving the truck on his own. There needs to have been a load in the trailer or going to or from the loading dock. If these situations are not met, the trucking company, in many instances, will leave the truck driver out on his or her own.

All of this comes down to is insurance. Depending on who is named as liable for the accident, an individual will be covered by either the truck driver’s insurance plan or the carrier’s plan. If the driver is operating of his own accord, he will have his own insurance plan that will most likely cover injuries and damages to a certain dollar amount. If the driver was operating the vehicle as an employee of a trucking company, then the trucking company’s insurance policy will, in most cases, be a party to any lawsuit as well.

As you can see, when it comes to truck accidents, things can get a little more complicated. And who better able to help you navigate these waters than truck accident injury lawyers? Just remember that truck accidents aren’t like vehicle accidents and you really should contact truck accident injury lawyers as soon as you can so you don’t create a problem for your claim.

If you’ve been in a car accident that’s more than just a fender-bender, you’ll probably want the counsel or services of the best car accident attorneys you can find. The point is you don’t want to hire just any attorney for your serious injury claim. You want someone who has a good amount of experience representing people that have had personal injury cases similar to yours. However, not only do you want an experienced attorney but you also want one that you genuinely feel you can trust.

How to Begin Your Search for the Best Car Accident Attorneys

There are several ways to find the best car accident attorneys. Remember, you are hiring them to do work for you. So, the same way you would shop for a contractor to build your house or for a serviceperson to do some extensive work, in a nutshell, what you want to do is get some referrals and then comparison shop. You, ultimately, are in control of who you decide to hire.

Once you get the names of several car accident attorneys, call them to set up a meeting time, and then meet with them so that you can discuss your case face to face. You want to see how they treat you, how they communicate with you, and just the overall vibe you get in general from being around them.

But realize that just because you have a claim and they are an attorney, it doesn’t mean they will automatically take your case. In other words, don’t be alarmend if they reject your case. Don’t take it personal. They’re not rejecting you; they’re rejecting your case. The fact of the matter is attorneys do not take cases if they fall below a certain potential recovery amount, or if the claim is not crystal clear, especially when you’re trying to hire the best car accident attorneys.

Here’s Where You Can Look for Referrals to Find the Best Car Accident Attorneys

Family and Friends

The first and easiest place to start looking for the best car accident attorneys is by talking with family, friends, coworkers or acquaintances who have been represented by a car accident attorney. If someone has a good recommendation for an attorney, write the name on your list as a potential candidate to interview. Please understand this though. You should not choose an attorney based solely on someone else’s recommendation.

Attorneys are people and different people can have a different experience with the same car accident attorney. Not everyone will relate the same way to an attorney’s style and personality. To put it simply, don’t make up your mind about attempting to hire the best car accident attorneys until you’ve met with them, discussed your case, and decided that you feel comfortable working with them and believe you can trust them to handle your case.

Other Attorneys

If you have some type of attorney that you consult or work with already, they can be a source for a referral. Attorneys routinely refer cases to one another, and most attorneys will know someone else who handles personal injury cases. As with referrals from family or friends, don’t make your decision to hire the best car accident attorneys based solely on another attorney’s word. Just like before, put their name on your list as a potential candidate that you will research further.

Referral Services

Most local bar associations have referral services where lawyers are available. (A simple Google search for “local bar associations” can help you there.) However there’s something you need to understand. Not all state bar associations are set up the same way. Some are unified and some are voluntary. Likewise, not all of the attorney referral services are set up the same way.

Some lawyer referral services carefully screen attorneys and list only those attorneys with particular qualifications and a certain amount of past experience, while other services will list any attorney in good standing with the state bar who maintains liability insurance. So to gain greater clarity, when you contact a lawyer referral service, just be sure to inquire about what its qualifications are for including an attorney and how carefully are attorneys screened. In your internet search, you may find that some local bar associations have websites and some of that information may be listed on there.

While an attorney referral service can obviously be a good referral source for the best car accident attorneys, you still can’t base your decision to hire a car accident attorney on this alone. Like always, you put them on the list as a potential candidate to meet and interview face to face.

Choosing the Best Car Accident Attorneys for You

You’ve asked around, inquired, done some research, made a list, and set appointments. Now, to find out whether a particular car accident attorney is right for you, you have to sit down with the attorney to discuss your claim and possible ways of handling it. However, so that they can have a better idea and are able to better advise you about your claim, don’t go empty handed. You need to take copies of all your documents like police report, medical records and bills, income loss information, and any and all correspondence with the insurance company.

Most attorneys don’t charge for a free initial consultation. However, you still need to ask, before you meet with the attorney, whether or not they will charge you for the first interview. And please listen. If an attorney wants to charge you just for discussing whether or not they will take your case, politely decline to meet with them, cross them off your list, and move on to the next one.

If after meeting with who you feel are the best car accident attorneys, because you are confident in their experience and comfortable with their strategy in handling your case, chance are you have indeed found the best car accident attorneys to work with.

Working with the Best Car Accident Attorneys

On a final note, once you’ve found the best car accident attorneys, your job isn’t entirely over. You’ll need to discuss with them a clear, written fee agreement and then keep in contact with them to make sure your case is progressing as it should.

Auto accident attorney fees may not be the first thing that comes to mind after an auto accident, but it may be in your thoughts fairly soon after as you begin to reflect on what’s happened and assess your situation moving forward. Again, there are a lot of factors you’ll be dealing with, but let’s just discuss auto accident attorney fees specifically.

As you will see from the videos below and as you constantly see and hear on all of the attorney ads, you don’t have to pay them unless they win your case. So then, the question becomes how much will it be when they win? Well, attorneys usually work on a contingency basis. The amount of the auto accident attorney fees can range from
25 – 40 percent with the typical amount being a third of the settlement. But, it can be on the higher end if the case goes to court or litigation.

While attorneys may work on a contingency basis, when you sit down and talk to them, don’t be afraid to ask about any and all other costs associated with your case that you may have to pay. Remember, whatever you agree to, you will be contractually obligated to pay, so be aware of every nickel and dime before you sign the agreement for your auto accident attorney fees.

The two videos below discuss this information. However, the second video is included because it presents an interesting situation that you may find yourself in and it should be something you discuss upfront with your attorney so be sure to watch that one too.

They understand the stress car accident victims are under in trying to balance getting their vehicle fixed, recovering from their injuries, and finding a way to pay for their medical expenses. Car accident attorneys strive to be part of the solution and not the problem.

With that being said, car accident attorneys are always cautioning you about the do’s and don’ts of how to handle car accidents. You would never want to be a problem or a hindrance in your own case. So, it’s imperative that you’re careful about what you say after your accident. This article by Eugenie Ybarra tells you some statements you shouldn’t make. Hopefully, you find the information helpful.

5 Things You Should Never Say After a Car Accident

By Eugenie Ybarra

“Anything you say can and will be used against you in court.”

While the Miranda rights are only read upon arrests, this sentence warning you to watch what you say is applicable in personal injury cases as well.

Determining who receives compensation in a car accident case depends heavily upon figuring out who was at fault, and words spoken by both parties involved in the incident play a significant role in establishing blame later on in court. That is why it is important to avoid saying these five things if you get into a car accident:

1. “I’m sorry.”
When a car wreck occurs, many people’s first response is to apologize, even if the accident is not their fault. What they generally mean is that they are sorry that the accident happened and that people may have been hurt. However, a simple “I’m sorry” can be used against you as an admission of guilt later in court.

Even if you think that the accident may have been your fault, resist the temptation to say “I’m sorry.” These two words can mean the difference between a long, drawn-out case and a big insurance check.

2. “It’s okay, I’m not hurt.”
No matter how you feel immediately following the accident, never say that you are not hurt. Many internal injuries or whiplash wounds are almost impossible to notice right away, and only the experienced eye of a doctor will be able to determine the extent of your injuries. Also, adrenalin and shock from getting in a wreck may mask pain sensations until later when the shock subsides.

By saying that you are not hurt at the scene of the accident, any injury claims that you later make in court may be discredited since you expressed that you were okay originally.

3. “I think… “
Uncertainty is your worst enemy in a car accident case, particularly when speaking to an insurance adjustor. You only want to state the facts of the wreck and leave out any speculation.

For instance, don’t guess at what speed you were driving or give an opinion about what led to the accident. Stick to the facts, and let the police report fill in what you aren’t sure about.

4. “Sure, I’ll give a recorded statement.”
The insurance adjustor may try to get you to submit to a recorded statement discussing the details of the accident. Do not fall for this trick. Adjustors will oftentimes take statements and distort them or present them out of context in order to paint the plaintiff in an untrue light, which may reduce your injury claim.

5. “Yes, I will accept that offer.”
One of the biggest mistakes you can make is agree to an offer from an adjustor before consulting an attorney. Insurance companies notoriously low-ball accident victims by tricking them into accepting fast money now, as opposed to engaging in a long-term legal battle for just compensation.

Even if a settlement offer from an adjustor seems adequate at first, never accept it before seeking legal counsel from a car accident lawyer. Many accident injuries require extensive, long-term care and treatment, and what the insurance company offers is insufficient to pay for future medical expenses.

Avoid saying these five things and you won’t have to worry about hurting your case.

Article Source: http://EzineArticles.com/?expert=Eugenie_Ybarra

As the article stated and what car accident attorneys will tell you, what you say can and will be used against you in a court of law. As honest and innocent as your statements might be, your words can be twisted to paint a totally different picture than the one you intended, leaving car accident attorneys a big hurdle to try and get over. So know that less is definitely best.
